| Dan is a leading litigator and counselor at the firm, where he concentrates on business disputes, construction law, and commercial litigation. He has been engaged in a wide-range of cases involving business and individual disputes since 1993. He regularly represents business owners, general contractors, subcontractors, design professionals, and construction suppliers. Dan has successfully represented clients in construction, oil and gas, landlord-tenant, commercial development and computer software disputes. His experience includes prosecuting and defending business torts including fraud, negligent misrepresentation, concealment, conversion, breach of fiduciary duty, and violation of the Colorado Consumer Protection Act. Dan’s expertise also includes general commercial and real estate litigation. Dan’s recent work includes multiple construction defect cases, several multi-million dollar construction acceleration, delay and inefficiency cases, numerous warranty claims. Most recently, Dan arbitrated a complex dispute involving the design and construction of a South-American solids-handling and ship-loading facility before the International Court of Arbitration of the International Chamber of Commerce (ICC). Additionally, he has litigated claims involving the design and construction of hospitals, numerous mechanic’s lien disputes, several multi-million dollar disputes regarding business enterprise software, and various disputes between commercial landlords and tenants. Dan has successfully tried cases in state and federal courts, as well as the U.S. Court of Federal Claims and the ICC International Court of Arbitration. Dan has significant arbitration and mediation experience. Dan also advises business clients on contract drafting, negotiation and risk management, as well as coordinating dispute resolution strategies before litigation is initiated.
